Most offences listed on expiation notices incur demerit points once the notice is paid. Expiation notices in relation to traffic matters are issued by the police and can include offences such as speeding, using a mobile phone while driving failure to wear a seatbelt and many more.
If a person incurs more demerit points than their licence permits they will be liable to be disqualified from driving. Some drivers may be eligible for the ‘good behaviour’ option while some drivers who are eligible for the ‘good behaviour’ option choose not to exercise that option.
If demerit points may cause you to lose your licence or be close to losing your licence you should contact our office immediately. We can examine your matter and either negotiate with the expiation notices branch for you or advise you whether you need to elect to be prosecuted.
You can elect to be prosecuted and once the matter is before the court we will prepare an application on your behalf for a reduction in demerit points.
